Anota Terms of Service (Beta)

These Terms of Service (the "Terms") set out the conditions for using Anota, a Markdown note service (the "Service") provided by SOFT-JP ("we"). By using the Service, you ("you" or the "user") agree to these Terms.

Article 1 (Scope)

  1. These Terms apply to all relationships between us and you regarding the use of the Service.
  2. Individual notices and instructions we post in the Service form part of these Terms.
  3. How we handle your information is described in our Privacy Policy.

Article 2 (Beta)

  1. The Service is a beta under development. Features, screens and specifications may be added, changed or removed without notice.
  2. Anyone with a Google account can start using the Service personally.
  3. Team use is available only to teams we invite ("teams").

Article 3 (Fees and plans)

  1. The Service has a free plan. The free plan limits the number of notes and the total size of uploaded images, and shows ads.
  2. The paid plan is in preparation. We will announce it in the Service in advance before starting a paid plan or changing the free plan.
  3. Exceeding a limit does not delete notes you have already saved. You cannot create new notes until you are below the limit.

Article 4 (Accounts)

  1. For personal use, you sign in with your Google account, and your account is created the first time you sign in. If you lose access to your Google account, you will not be able to sign in to the Service, and we do not recover such accounts.
  2. For team use, you sign in with the Google or Microsoft account whose email address your team administrator registered. Team administrators have the authority and responsibility to add, change and suspend users in their team.
  3. You are responsible for managing your account and the API keys you issue in the Service, and must not let third parties use them.
  4. To delete your account, contact us at the address below.

Article 5 (Your data)

  1. Rights to the notes, comments, images and other data you save in the Service ("your data") belong to you or the rightful owner.
  2. We handle your data only as needed to provide and maintain the Service, handle failures and investigate misuse.
  3. Notes in folders you make public, and notes visible through share links you issue, can be read by anyone on the internet. You are responsible for setting what you publish.
  4. During the beta, your data may be lost due to failures. Please keep your own copies of important data.

Article 6 (Prohibited conduct)

When using the Service, you must not:

  1. Violate laws or public order and morals
  2. Infringe copyrights, trademarks, privacy or other rights of others
  3. Place excessive load on our servers or network, or interfere with the operation of the Service
  4. Search for or exploit vulnerabilities in the Service (except testing we have approved in advance)
  5. Impersonate others, or access other users' or teams' data without authorization
  6. Store or distribute malware or other harmful programs
  7. Use the publishing features to spread illegal content, content that harms others, spam and the like
  8. Engage in any other conduct we reasonably consider inappropriate

Article 7 (Suspension)

If we determine that you have violated these Terms, or if necessary to operate the Service, we may, without prior notice, stop publication, delete content, or suspend the user or team.

Article 8 (Changes, interruption and termination of the Service)

  1. We may interrupt all or part of the Service for maintenance, failures or other reasons.
  2. We may end the Service by announcing it in the Service at least 30 days in advance. When we do, we will try to give you time to export your data.

Article 9 (Disclaimer and limitation of liability)

  1. The Service is provided as is. We do not guarantee that it will run without interruption or errors, or that it will fit any particular purpose.
  2. Except in cases of our intent or gross negligence, we are not liable for damages arising from your use of, or inability to use, the Service. Where laws such as the Consumer Contract Act invalidate this provision, we are liable to that extent.

Article 10 (External services)

The Service uses Google / Microsoft authentication for sign-in, Slack / Microsoft Teams webhooks for notifications, and Google AdSense for ads. The terms of each provider apply to the use of these services.

Article 11 (Changes to these Terms)

We may change these Terms as needed. When we do, we will announce the changes and when they take effect in the Service. The changed Terms take effect at the announced time.

Article 12 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance for any dispute regarding the Service.
